Hanefiler “muhalefet/red” konusunu kabul etmezken, İslâm hukukçuları, hük mü belirlenmemiş anlamına gelen “meskûtu anh” konusunu, ancak usulcülere
göre kavramın anlamlarından olan “muvâfakat/kabul” ve “muhâlefet/red” ko nuları kapsamında tanımlamıştır.
Dilbilimcilere göre ise anlamlar çeşitlidir. Onlar bu konuda farklı ayırımlarda
bulundular. Bu ayırımlardan biri de “hakiki” ve “mecazî” anlamlardır.
Bu makale, “meskûtu anh” kavramının lügavî önemini incelemeyi; onun, usul cüler ve dilbilimcilere göre manaya olan delaletini, çeşitlerini belirlemeyi ve
ortaya çıkışlarını öğrenmeyi amaçlamaktadır. Buradan hareketle iki anlam ara sındaki ilişkiyi; “meskûtu anh” kavramının hangi lügavî anlamlara bağlı oldu ğunu; usulcü ve dilciler arasında kavrama dair benzer ve farklı yönleri tespit
etmeyi amaçlamaktadır. Makale, aynı şekilde modern edebiyat eleştirisi bağla mında “meskûtu anh” kavramının sınırını çizmeyi, onun “beyâdât”, “ferâgât”,
“huzur”. “gıyâb” gibi diğer kavramlarla ilişkisini tanımlamayı ve onun fıkıh il mindeki “meskûtu anh” kavramıyla bir uygunluk arz ettiğini araştırmayı hedef lemektedir.
Bu makalenin ulaştığı bazı sonuçlar ise şunlardır: Meskûtu anh’ın anlamı
mecazî bir anlamdır ve mecaz, ondan daha kapsamlı olmasına rağmen meskûtu
anh, lügavî mecazın çeşitlerinden biri sayılır. Bu itibarla meskûtu anh ile bağ lantılı olan “muvâfakat” kavramı hakkında, bazı usulcülere göre lafzî, diğerle rine göre ise kıyasî ya da mecazîdir diye bir sonuç çıkarılabilir. Bu sonuç ise
birçok dilbilimciye göre delaletin lafzî; diğerlerine göre de kıyasa dayalı delale tin, mecazî olduğu görüşüyle uyuşmaktadır. Bunun nedeni, belki de kavramla rın çeşitliliğine; usulcülerin ise dilbilimcilerin meskûtu anh anlamlarına ilişkin
ıstılahlarına itimat etmemelerine dayanmaktadır. Mecaz kavramı da aynı dö nemde, yani hicri ikinci asrın sonu ve üçüncü asrın başında ortaya çıkmıştır.
Yine bu çalışmamızda, modern eleştirel edebiyattaki meskûtu anh kavramı ile
fıkıhtaki meskûtu anh kavramının, anlam bağlamında birbirine yakın olduğu
sonucuna varılmıştır.
Jurists didn’t define the (kept silent) terms except from the tow concepts of
approval and violation which are the divisions of the understandable significan ce that’s according to the fundamentalists, while al-Ahnaf denied the violation
at all according to the linguists.
The significances are differs and it was divided differently as read or metaphori cal divisions.
This research tries to study the linguistic significant of the (kept silent) terms
and defines the term itself it’s division and when it get started. Then matching
between the two significant and pointing to which linguistics significant it be longs and determines the similarities and differences between them. Also the
research tries to define the (kept silent) term in the modern literary criticism, and
it’s relationship with the order significant as linens and spaces attendance, and
absence. and study how much it harmonize with the term in jurisprudence.
The result of the research is that the (kept silent) a kind of the linguistic metap hor is more comprehensive than the (kept silent). This conclusion comes from
that the concept of approval (which is one section of the understandable signifi cance the fundamentalists call it the (kept silent). Some fundamentalists consi der the concept of approval as verbal indication while others consider it as me taphor one. This is matching with what the linguists said, because they consider
most of the metaphors. The cause of the multiple terminology was that the terms
of the (kept silent) and the metaphor were appeared (at the same period of time
at the end of the second century and the beginning of the third one).
Also the research reached to: the (kept silent) term in the modern literary criti cism is similar to the (kept silent) term in jurisprudence (fiqh).
